Terms of Use for Digital Guides

These terms govern the use of the English-language digital guides published by unterHUNDs. Please read them before you buy a guide.

1. Scope

  1. These terms apply to the English-language digital guides (the "guides") offered on unterhunds.de and published by:
    Mario Raczek & Michael Sauerwein GbR, Hundeschule unterHUNDs, Rubensstraße 8, 66663 Merzig, Germany ("unterHUNDs", "we", "us"). Further details can be found in our legal notice.
  2. They apply in addition to the terms of the seller shown at checkout (see section 2).

2. Purchase and payment

  1. Our guides are sold through Link, a service of Stripe, which acts as merchant of record. This means that you conclude the purchase contract with Link, not with unterHUNDs. The seller is named on the checkout page and on your receipt.
  2. Payment, sales tax, receipts and invoices, payment-related support and refunds are handled by Link under the terms shown at checkout. The same applies to any statutory right of withdrawal you may have as a consumer.
  3. We are responsible for the content of the guides. For questions about the content, please contact us at info@hundeschule-unterhunds.de.

3. Access to your guide

  1. You receive access to the guide after successful payment, as described on the product page. The guides are provided digitally only; no physical copy is shipped.
  2. To use the guides, you need an internet-enabled device, a current browser and software that can open the file format stated on the product page.
  3. Your statutory rights regarding defects in digital content remain unaffected.

4. License

  1. The guides, including all texts, worksheets, illustrations and photos, are protected by copyright.
  2. With your purchase, you receive a simple, non-exclusive and non-transferable right to use the guide for your own personal purposes. You may store it on your own devices and print it for your own use.
  3. Without our prior consent in text form, you may not reproduce, pass on, sell, publish, make publicly available or use the guides or parts of them commercially – for example in your own courses, training sessions or client materials. This also applies to the worksheets.

5. Nature of the content

  1. The guides provide general, evidence-based information on dog behavior and training. They do not replace an individual assessment of your dog by a qualified dog trainer or behavior consultant.
  2. If your dog shows signs of pain, illness or a sudden change in behavior, please consult a veterinarian first. If your dog poses a risk to people or other animals, please seek professional help on site.

6. Liability

  1. We are liable without limitation for damage resulting from injury to life, body or health, for damage based on intent or gross negligence, and under the German Product Liability Act.
  2. In cases of slight negligence, we are liable only for the breach of an essential contractual obligation, that is, an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose fulfillment you may regularly rely. In this case, our liability is limited to the typical, foreseeable damage.
  3. Any further liability is excluded. The above limitations of liability also apply to our legal representatives and vicarious agents.

7. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

8. Final provisions

  1. These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the law of the country in which you have your habitual residence.
  2. If you are a merchant, a legal entity under public law or a special fund under public law, Merzig, Germany, is the exclusive place of jurisdiction. For consumers, the statutory places of jurisdiction apply.
  3. Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provisions.
